AIFC Court and IAC agreed enhanced judicial training cooperation with the Academy of Justice of the Supreme Court of the Republic of Kazakhstan
The Rector of the Academy of Justice at the Supreme Court of the Republic of Kazakhstan (“the Judicial Academy”), Ms. Zauresh Baimoldina, visited the AIFC Court and IAC. Enhanced cooperation with the AIFC Court and IAC was agreed including the use of the AIFC Court and IAC as a “Centre of Excellence” to provide annual training on international dispute resolution to judges in the Kazakhstan national judicial system and judicial students at the Judicial Academy. The AIFC Court and IAC will provide Judicial Academy students with four annual training sessions on international mediation, judicial independence, case management, and judgment writing skills. This training will also be extended to the national judiciaries of all eight countries in which the AIFC Court and IAC now have use of world class premises and digital technology for case hearings involving investors from those countries with investments in Kazakhstan: Armenia, Azerbaijan, Georgia, Kyrgyzstan, Tajikistan, Turkey, Turkmenistan, and Uzbekistan.
The AIFC Court and IAC have since their operations commenced on 1 January 2018 provided more than 70 training programmes for more than 3,000 Kazakh national lawyers and law students, working in partnership with world leading legal education and professional lawyer experts from leading institutions including Cambridge University and University College London in the UK. This training is critical to the long term success of the AIFC Court and IAC and to the understanding of the business and legal communities in Kazakhstan and more widely in Eurasia. It contributes to the continuous improvement of practical skills and use of the AIFC Court and IAC by the lawyers of investors coming to Kazakhstan who want international standard commercial dispute resolution that is independent and impartial. It enables the AIFC Court and IAC to continually make a significant contribution to the overall attractiveness of Kazakhstan as a credible and trusted investment hub.
The Astana International Financial Centre (AIFC) is an independent jurisdiction that started operations in 2018. The AIFC Court is an independent legal entity. It has its own procedural rules modelled on English common law procedures and leading international practice. The AIFC Court is separate and independent from the courts of the Republic of Kazakhstan. It consists of two tiers: a Court of First Instance, which includes a specialist division known as the Small Claims Court; and a Court of Appeal. It has exclusive jurisdiction over disputes arising out of the activities and operations of the AIFC and jurisdiction in the case of other disputes in which all parties agree in writing to give the AIFC Court jurisdiction. The International Arbitration Centre (IAC) is an independent legal entity. It has its own procedural rules modelled on best international practice. It has its own panel of leading international arbitrators and mediators having many years of arbitration and mediation experience in commercial law, including oil and gas, trade, construction, energy, financial services, banking, Islamic finance, insurance, and intellectual property.
